Riplet Terms of Service

Welcome to Riplet ("we," "our," or "us"). Please read these Terms of Service ("Terms") carefully before using the Riplet iOS application ("App") operated by Frigid Light, LLC.

By downloading, accessing, or using our App, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access or use our App.

1. Use of the App

License: Frigid Light, LLC grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes subject to these Terms.

Restrictions: You agree not to, and will not permit others to:

• License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the App
• Copy or use the App for any purpose other than as permitted under this license
• Modify, make derivative works of, disassemble, decrypt, reverse compile or reverse engineer any part of the App
• Remove, alter or obscure any proprietary notice (including any notice of copyright or trademark) of Frigid Light, LLC or its affiliates, partners, suppliers or licensors

2. User Data

Data Ownership: You retain ownership of all data you create or store within the App. We do not claim ownership over your content.

Data Storage: Your data is stored locally on your device or, if you enable iCloud sync, in your private iCloud account associated with your Apple ID.

Data Privacy: Please refer to our Privacy Policy for information on how we handle your data.

3. Third-Party Services

The App may use third-party services provided by Apple and other entities:

• Apple MapKit for map visualization
• CoreLocation for geocoding and location services
• CloudKit for data synchronization
• Open-Elevation API for elevation data

Use of these services is subject to their respective terms and privacy policies.

4. Intellectual Property

The App and its original content, features, and functionality are and will remain the exclusive property of Frigid Light, LLC and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Frigid Light, LLC.

5. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the App will immediately cease. If you wish to terminate your account, you may simply discontinue using the App.

6. Limitation of Liability

In no event shall Frigid Light, LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the App
• Any conduct or content of any third party on the App
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the App
• Any bugs, viruses, trojan horses, or the like which may be transmitted to or through the App by any third party

7. Disclaimer

Your use of the App is at your sole risk. The App is provided on an "AS IS" and "AS AVAILABLE" basis. The App is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Frigid Light, LLC, its subsidiaries, affiliates, and licensors do not warrant that: (a) the App will function uninterrupted, secure or available at any particular time or location; (b) any errors or defects will be corrected; (c) the App is free of viruses or other harmful components; or (d) the results of using the App will meet your requirements.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Massachusetts, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the App.
